Xorble accepts no liability for the service provided or for the consequences of any actions taken on the basis of the information provided.
2. Disclaimers of Warranties
Xorble provides no warranty of any sort for the service and reserves the right to withdraw or change the service at any time. Xorble does not warrant the accuracy or completeness of the information and materials and expressly disclaims liability for errors or omissions in this information and materials.
NO WARRANTY OF ANY KIND, IMPLIED, EXPRESSED OR STATUTORY INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF NON-INFRINGEMENT OF THIRD PARTY RIGHTS, TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND FREEDOM FROM COMPUTER VIRUS, IS GIVEN WITH RESPECT TO ANY CERTIFICATE, SOFTWARE, INFORMATION, OR OTHER ITEM LOCATED ON, DERIVED FROM, OR LINKED TO BY THIS WEBSITE. EVERYTHING IS PROVIDED "AS IS," "AS AVAILABLE." Use of this service and any service derived wholly or in part from this website is at your own risk. You assume the entire risk of loss of data through the use of encryption using certificates issued by Xorble. Xorble accepts no liability for lost encryption keys however this may occur. You assume the entire cost of all necessary servicing, repair, or correction of your property or operations as a result of using this website. You also accept, at your own risk, that the Internet and online communications medium may not perform as intended despite our efforts, those of your Internet service provider, or you.
3. Privacy of certificates
Xorble automatically publishes all certificates to a web service. All user certificates contain user the email address but no other personal identification information. Certificates may be download from the web service if the email address of the user is already known.
4. Privacy of user data
Xorble aims to collect as little information about users as possible. User credentials (username/password) are not stored within the Xorble service but by external Identity Providers. Xorble does store certificates that are associated with an email address. We also store the list of which contact email addresses have been enrolled for certificates by which users.
5. Restrictions
You agree to not use the Services to:
I. engage in unlawful activity or to use the Services in an unlawful manner.
II. use the Services in any manner that is likely to damage, disable, overburden or impair the Services;
III. use automated scripts to collect information from or otherwise interact with the Services;
IV. transmit content that would reasonably be considered harmful, threatening, unlawful, defamatory, infringing, abusive, inflammatory, harassing, vulgar, obscene, fraudulent, invasive of privacy or publicity rights, hateful, or racially, ethnically or otherwise objectionable;
V. impersonate any person or entity, or falsely state or otherwise misrepresent yourself;
VI. transmit content that would constitute or encourage criminal offense, violate the rights of any party, create liability for Xorble, or violate any local, state, national or international law.
6. Intellectual Property Rights
This site contains trademarks, service marks and trade names owned by Xorble that are protected by applicable trademark and other intellectual property laws. Without the express prior written consent of Xorble and any other rights owner, you may not publicly display, perform, transmit, list, modify, reproduce, distribute, participate in the transfer or sale of, make derivative works from, upload or otherwise use any of the Xorble Intellectual Property contained on this website or the selection, arrangement or coordination of its content. If you receive such permission, you may not delete, change or in any manner or fashion alter or enhance the existing trademark notices. You should not assume anything on this site is necessarily in the public domain. Additionally, you agree not to post or use any information from this site for any advertising or solicitation for products or services without Xorble’s express prior written consent.
7. Indemnity
You agree to release, indemnify, defend and hold harmless Xorble and any of its contractors, agents, employees, officers, directors, shareholders, affiliates and assigns from all liabilities, claims, damages, costs and expenses, including reasonable attorney's fees and expenses, of third parties relating to or arising out of (a) your breach of these Terms, (b) falsehoods or misrepresentations of fact by you, or (c) your use or misuse of the Services. Xorble has the right to participate in any defence of a third-party claim related to your use of the Services, with counsel of our choice. You shall have sole responsibility to defend Xorble against any claim, but you must receive Xorble’s prior written consent regarding any related settlement. The terms of this paragraph will survive these Terms.
8. Force Majeure
Xorble is not responsible for any cessation, interruption or delay in the operation of the Services or performance of its obligations hereunder due to earthquake, flood, fire, storm, natural disaster, act of God or the public enemy, war, armed conflict, terrorist action, strike, lockout, boycott, riot, release of hazardous or toxic substances, explosion, accident, or any other causes whether or not of the same class or kind as those specifically above named.
9. Amendments
Any waiver of these Terms shall only be effective if it is in writing and signed by both parties. Xorble may change the Terms and the Services without prior notice to you. You should check the Terms each time you use or access the Services. Your use of the Services after any changes to the Terms constitutes your acceptance of the new Terms. Section headings are for convenience only and shall not be considered in the interpretation of these Terms.
10. Acceptance
BY USING THE SERVICES AND CLICKING "I AGREE", YOU AGREE TO BE BOUND BY AND COMPLY WITH ALL OF THE TERMS HEREIN. DO NOT USE THE SERVICES IF YOU DO NOT AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS.
